Welcome to NetherSX2. Please read these Terms of Service (“Terms”) carefully as they contain important information regarding your legal rights, remedies, and obligations. By accessing or using the NetherSX2 website, software, or services (collectively, the “Services”), you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you do not agree to these Terms, please do not use our Services.

2. Eligibility

3. NetherSX2 Services

3.1 Software License

NetherSX2 provides emulation software designed to allow users to play games they legally own on their devices. Subject to these Terms, NetherSX2 grants you a personal, non-exclusive, non-transferable, revocable license to use our software for personal, non-commercial purposes.

3.2 User Account

Some features of our Services may require you to create a user account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to promptly notify NetherSX2 of any unauthorized use of your account.

3.3 Service Modifications

NetherSX2 reserves the right to modify, suspend, or discontinue any aspect of the Services at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.

4. User Responsibilities

4.1 Lawful Use

You agree to use our Services only for lawful purposes and in accordance with these Terms. You are solely responsible for ensuring that your use of NetherSX2 software complies with applicable laws regarding intellectual property and copyright.

4.2 Game ROMs and BIOSes

NetherSX2 does not provide or distribute game ROMs, BIOSes, or other copyrighted material. You must legally own the original games and BIOS files you use with our emulation software. Downloading ROMs of games you do not own is illegal in most jurisdictions and violates these Terms.

4.3 Prohibited Conduct

You agree not to:

  • Use our Services for any illegal purpose or in violation of any local, state, national, or international law
  • Harass, abuse, or harm another person through our Services
  • Share or distribute content that is obscene, pornographic, violent, or otherwise objectionable
  • Impersonate another person or entity
  • Attempt to gain unauthorized access to our systems or networks
  • Transmit viruses, malware, or other harmful code
  • Interfere with or disrupt the Services or servers connected to the Services
  • Reverse engineer, decompile, or disassemble our software
  • Use our Services for commercial purposes without our express written consent
  • Sell, resell, rent, lease, or distribute our software or any part of our Services

5. Intellectual Property

5.1 NetherSX2 Property

The Services, including all content, features, and functionality, are owned by NetherSX2 or its licensors and are protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any right, title, or interest in the Services or our content.

5.2 Feedback

If you provide feedback, ideas, or suggestions regarding our Services (“Feedback”), you grant NetherSX2 an unrestricted, perpetual, irrevocable, non-exclusive, fully-paid, royalty-free right to use the Feedback in any manner without compensation or attribution to you.

6. User Content

6.1 Content Ownership

You retain ownership of any content you submit to our Services, such as forum posts, comments, or other materials (“User Content”). By submitting User Content, you grant NetherSX2 a worldwide, non-exclusive, royalty-free license to use, copy, modify, create derivative works based on, distribute, and display your User Content for the purpose of operating and improving our Services.

6.2 Content Responsibility

You are solely responsible for your User Content. You represent and warrant that you own all rights to your User Content or have obtained all necessary permissions, and that your User Content does not violate these Terms or any applicable laws.

Our Services may contain links to third-party websites or services. NetherSX2 is not responsible for the content or practices of any third-party websites or services. These links are provided for your convenience only, and the inclusion of any link does not imply endorsement by NetherSX2.

8. Disclaimers

8.1 No Warranty

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. NETHERSX2 DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

8.2 Game Compatibility

While NetherSX2 strives to provide compatibility with a wide range of games, we make no guarantees regarding the compatibility of any specific game with our emulation software.

9. Limitation of Liability

IN NO EVENT SHALL NETHERSX2, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR SERVICES, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR SERVICES, (V) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH OUR SERVICES BY ANY THIRD PARTY, AND/OR (VI) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.

10. Indemnification

You agree to defend, indemnify, and hold harmless NetherSX2, its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from: (i) your use of and access to the Services; (ii) your violation of any term of these Terms; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your User Content caused damage to a third party.

11. Termination

NetherSX2 may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which NetherSX2 is established, without regard to its conflict of law provisions.

13. Changes to Terms

NetherSX2 reserves the right to modify or replace these Terms at any time. We will provide notice of any material changes through the Services or by other means. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect and enforceable.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and NetherSX2 regarding our Services and supersede all prior agreements and understandings, whether written or oral.
